Buying

When we receive the purchase documents from your realtor, we review the title and tax status of the property you are purchasing to ensure that conditions are put in place to remove any existing registrations or encumbrances against the title that should not remain indefinitely on closing.

Once we receive instructions to prepare your mortgage from your chosen financial institution, we work to ensure a smooth process for preparing and signing your mortgage documents prior to possession.

We also confirm that your insurance is correct and that Title Insurance (or a Surveyor’s Certificate) is available for your property. We collect all funds needed on the transaction and ensure that both yourself and the seller have completed all requirements in order to grant possession and notify your realtor so that you can enjoy your new property. 

Selling

We review the sale documents from your realtor and the title to your property. We correspond with the municipality and, if you have a mortgage on the property, your financial institution to receive your payout statement. We will prepare all necessary documents, including Consents of Non-Owning Spouse if required, and arrange with you to complete the same. Once we have all funds in place from the purchaser and both sides have executed their documents, we confirm that your realtor is okay to release keys to the purchaser on possession day. When the funds are releasable, we ensure that your real estate commission, property tax adjustment, mortgage, our office, and any other third party payments are made on your behalf from the sale proceeds, and then deposit the net sale proceeds as you direct. 

Gifting Real Estate

When gifting property versus selling, there are a number of financial, tax, and legal consequences that must be taken into account. While your love and affection for your family member is always the most important reason for these kinds of transfer, we want to ensure we are not triggering unintended consequences. We work with you, your accountant, and your financial institution, as applicable, to determine the best course of action needed to gift your chosen asset to your loved ones in a way that considers your unique situation and matches the intention behind your gift-giving. We then prepare all the necessary documents to effect such transfer and provide copies to all parties 

Rentals

 If you are looking to rent out your property, we can help you prepare a rental agreement that sets out the obligations of the renter and you as the landlord. We will also discuss with you the requirements of The Residential Tenancies Act to ensure you are aware of the requirements and regulations laid out in the same. It is important to have your rental agreement in writing so that everyone has the same expectations and that you and your assets are protected in the best legal way. If you are a renter, we can review the agreement provided by your landlord and let you know if there are any concerns with the same.
